Payment Details
Full payment shall be made by certified bank check only, payable to the Town of Wakefield, and must be received by the Town no later than five (5) calendar days following the close of the auction. Payment in full is required before any item may be released to the buyer. Additional fees, terms and conditions required by the auction site, are to be the responsibility of the buyer only. The Town reserves the absolute right to reject any bid or to cancel any sale if the buyer fails to remit payment within the specified timeframe.

This 1995 Case 580 Super L backhoe has 6,718 original hours and has spent its entire life in a well-managed fleet. It has been serviced by professional fleet mechanics following the manufacturer’s recommended maintenance schedule and repaired at the first sign of any issues. Overall, it is in good working condition and has been a very reliable machine.

Buyers are solely responsible for completing all necessary due diligence prior to submitting a bid. Bids will NOT be accepted unless submitted through the auction website. By submitting a bid, the buyer acknowledges and agrees that all sales are final, and that all items are sold “AS IS, WHERE IS,” with all faults, and without any guarantees. The Town expressly disclaims all warranties, whether express or implied, including but not limited to warranties of merchantability and fitness for a particular purpose. The asset will be sold, if at all, to the responsive bidder offering the highest price for the asset described in this advertisement and on the auction site listing. The Town of Wakefield reserves the right to reject any and all bids and to dispose of the equipment through a negotiated sale, provided that the negotiated sale price is higher than the highest bid received from a responsive bidder. Upon winning the auction, the winning bidder shall be required to submit a signed non-collusion form to the Town of Wakefield prior receipt of the equipment. Said non-collusion form shall be: “The undersigned certifies, under penalties of perjury, that its Bid has been made and submitted in good faith and without collusion or fraud with any other person. As used in this certification, the word “person” shall mean any natural person, business, partnership, corporation, union, committee, club or other organization, entity, or group of individuals.” The winning bidder shall also certify, in writing, that, pursuant to M.G.L. c. 62C, §49A, that it is in compliance with all laws of the Commonwealth of Massachusetts pertaining to taxes, to the reporting of employees and contractors, and to the withholding and remittance of child support. The buyer is solely responsible for arranging and completing in-person pickup of all purchased items at the Town of Wakefield Department of Public Works within ten (10) calendar days after the Town’s receipt of full payment. The Town does not provide shipping, delivery, or loading services, and shall bear no responsibility for the transportation of purchased goods.
